G1 driver charged with impaired at early morning traffic stop in Kapuskasing

KAPUSKASING - An early morning traffic stop led to impaired charges for a Kapuskasing man who is not licenced to be driving alone or at that time of day. 

Yesterday (May 8) just after 1 a.m., James Bay OPP pulled over a vehicle on Ontario Avenue in Kapuskasing. 

The officer determined the driver had been drinking. The driver was arrested and brought back to the Kapuskasing detachment for testing. 

In Ontario, there are different licence classes for drivers. The first level is the G1 licence, which means that the person holding it can only drive when there is a fully licenced driver with at least four years of experience in the vehicle. 

The accused held a G1 licence, which does not allow them to drive between midnight and 5 a.m. or if they've been drinking alcohol.

A 41-year-old man from Kapuskasing is charged with:

  • Operation while impaired - alcohol and drugs
  • Operation while impaired - blood alcohol concentration (80 plus)
  • Use plate not authorized for vehicle
  • Operate unsafe vehicle
  • Class G1 licence holder - drive at unlawful hour
  • Class G1 licence holder - unaccompanied by a qualified driver
  • Novice driver - fail to surrender licence

The accused was released and is scheduled to appear in court on June 3 in Kapuskasing. The vehicle was also impounded for seven days, and his driver's licence is suspended for 90 days. 

None of the charges have been tested in court and the accused is considered innocent unless proven guilty.
