Impaired driver refuses testing: OPP

Police say not complying without a reasonable excuse is a criminal offence

KAPUSKASING - A driver accused of driving impaired had cannabis readily available, says police.

Around 10 a.m. on Sept. 20, James Bay OPP stopped a vehicle on Bouldier Street in Kapuskasing. 

Officers say the driver had consumed an intoxicating substance and was arrested. At the police detachment, the driver refused further testing.

"Under the Criminal Code, refusal to comply with a lawful demand to provide breath sample or submit to a Drug Recognition Evaluation (DRE) without a reasonable excuse is a criminal offence, carrying the same penalties as an impaired driving charge," said police in a news release. 

A 43-year-old from Kapuskasing is charged with: 

  • Operation while impaired - drugs
  • Failure or refusal to comply with demand
  • Possession of a schedule I substance - Methamphetamine
  • Drive vehicle with cannabis readily available
  • Operate a motor vehicle without insurance
  • Fail to carry permit in vehicle

Their vehicle was impounded for seven days and their driver's licence is suspended for 90 days.

The accused was released from custody and is scheduled to appear in a Kapuskasing court on Nov. 4.
