Timmins man accused of disarming peace officer, smashing OPP detachment window

MOOSONEE – On April 12, 2016 members of the Moosonee Detachment of the Ontario Provincial Police (OPP) responded to the sound of the front window of the detachment being smashed.

At approximately 3:20 a.m. officers exited the building and located a man who was acting irrationally.

The man was placed under arrest for the mischief he had just committed.

During the arrest the male brandished an edged weapon.

Officers deployed a Conducted Energy Weapon (CEW) and were able to gain physical control of the subject.

No serious injuries were sustained by any parties.

Stuart Sutherland, 35, of Timmins Ontario, has been charged with the following offences:

  • Two counts of assault with intent to resist arrest contrary to section 270(1)(b) Criminal Code of Canada (CC)      

  • Carry concealed weapon contrary to section 90 CC                                   

  • Disarming a peace officer contrary to section  270.1(1) CC                       

  • Fail to comply with probation order contrary to section 733.1(1) CC                    

  • Mischief under $5,000 contrary to section 430(4) CC                      

  • Possession of weapon for dangerous purpose contrary to section 88 CC                     

  • Two counts of uttering threats to cause death or bodily harm contrary to section 264.1(1)(a) CC     
    The accused has been remanded into custody and is to appear in bail court in the Ontario Court of Justice in Timmins on April 13, 2016.
