Circle K assault suspects identified, police uncover loaded handgun, drugs

The suspects in an unprovoked assault at a Timmins convenience store have been identified, with one of the suspects still being sought by police. 

The investigation and arrest of one suspect also led to police seizing a loaded handgun, drugs and locating a vehicle stolen from Sudbury earlier this month. 

On July 15 just before 2 a.m., a person was assaulted outside of the Circle K store at Algonquin Boulevard West and Cameron Street. The victim received serious, but non-life-threatening injuries, said Timmins Police in a news release.

The two, 17-year-old suspects were identified by police and charged with assault causing bodily harm. 

On July 18, police found one of the suspects inside a vehicle and they were arrested for the Circle K incident. They were also charged with obstructing police and assaulting police for an altercation during the arrest.

There is a warrant for the second suspect in the assault.

The other people in the car — an 18-year-old and two, 15-year-olds — fled the scene and were found at a Sixth Avenue residence. The vehicle they were in was reported stolen from Sudbury on July 12. 

Officers contained the Sixth Avenue residence while the teens were arrested. A loaded handgun, fentanyl and cash were found on one of the suspects, said police.

Daylen David of Timmins is charged with possession of property obtained by crime over $5,000, two counts of flight from peace officer, and two counts of dangerous operation of a conveyance. He was held in police custody waiting for a bail hearing.

A 15-year-old from Timmins is charged with possession of property obtained by crime over $5,000, multiple weapons offences including carrying a concealed  weapon, possession of a firearm for a dangerous purpose, possession of a loaded restricted firearm, possession of a schedule 1 substance for the purpose of trafficking, possession of a weapon contrary to a prohibition order and three counts of failing to comply with a release order. The accused was held in custody pending a bail hearing.

The second 15-year-old is charged with possession of property obtained by crime over $5,000 and breach of a sentence order. The accused was released on an undertaking.

None of the youth can be named under the Youth Criminal Justice Act. 

The charges haven't been proven in court and the accused are considered innocent unless proven guilty.
