Kirkland Lake OPP charge two with impaired driving over the holidays

OPP were requested to assist the Surete Du Quebec with stopping a motor vehicle that failed to stop for them and traveled into Ontario

KIRKLAND LAKE - On Dec. 21, 2019 at approximately 6:30 p.m., the Kirkland Lake Detachment of the Ontario Provincial Police (OPP) were requested to assist the Surete Du Quebec with stopping a motor vehicle that fail to stop for them and has traveled into Ontario.

Members of the Kirkland Lake OPP located the vehicle traveling West bound on Highway 66 in McVitty Twp and were able to safely stop the vehicle.

Further investigation revealed the driver was under the influence of alcohol.

As a result, Mike Delisle, 51 years old, of Rouyn-Noranda, Quebec, has been charged with the following:

  • Operation while impaired - alcohol, contrary to section 320.14(1)(a) of the Criminal Code (CC),
  • Operation while impaired - blood alcohol concentration (80 plus), contrary to section 320.14(1)(b) of the CC,
  • Operation while prohibited under the Criminal Code (two counts), contrary to section 320.18(1)(a) of the CC,
  • Fail to comply with probation order, contrary to section 733.1(1) of the CC,
  • Consuming liquor in other than licenced premises, residence or private place, contrary to section 31(2) of the Liquor Licence Act (LLA), and
  • Driving motor vehicle with open container of liquor, contrary to section 32(1) of the LLA.

The driver was issued a 90 day Administration Driver's Licence Suspension (ADLS) and the motor vehicle was impounded for seven days.

The accused was released on an undertaking and is scheduled to appear before the Ontario Court of Justice on January 30, 2020 in Kirkland Lake, Ontario.

KIRKLAND LAKE - On Dec. 28, 2019, members of the Kirkland Lake Detachment of the OPP were conducting a RIDE program on Archer Drive in the Town of Kirkland Lake, Ontario. At 8:37 a.m. police issued a breath demand into an Approved Screening Device (ASD) to a driver of a motor vehicle under the authority of the Mandatory Alcohol Screening (MAS) law, resulting in a "fail."

As a result, Andrew Burdick, 44 years old, of Kirkland Lake, Ontario has been charged with the following:

  • Operation while impaired - Alcohol, contrary to section 320.14(1)(a) of the Criminal Code (CC), and
  • Operation while impaired - Blood Alcohol Concentration (80 plus), contrary to section 320.14(1)(b) of the CC.

The driver was issued a 90 day Administrative Driver's Licence Suspension (ADLS) and the motor vehicle was impounded for seven days.

The accused was released on an Appearance Notice and is scheduled to appear before the Ontario Court of Justice on January 30, 2020 in Kirkland Lake, Ontario.

The OPP is reminding drivers that no amount of alcohol or drugs in your system is safe when driving.
