ATVer on Highway 11 charged with impaired

OPP impounded an ATV in Opasatika after the driver was charged with impaired.

OPASATIKA - An ATVer pulled over for not wearing a helmet is now facing impaired driving charges. 

Around 9 p.m. on July 6, James Bay OPP says it pulled over an ATV on Highway 11 in Opasatika because the driver was not wearing a helmet. 

While talking to the driver, police determined that the driver had been drinking alcohol. They were arrested and brought to the Kapuskasing detachment for more testing.

A 49-year-old from Leamington is charged with operation while impaired - alcohol and drugs, operation while impaired - blood alcohol concentration (80 plus), and drive off-road vehicle - no helmet.

The accused is scheduled to appear in court in Kapuskasing on Aug. 12. Their licence was also suspended for 90 days and the vehicle was impounded for seven days. 

None of the charges have been tested in court and the accused is considered innocent unless proven guilty.
